The paper examines the protection of freedom of expression online within the Spanish legal framework, in the context of European legislation and case law. After outlining the EU’s normative evolution—from the Charter of Fundamental Rights to the Digital Services Act, the Digital Markets Act, and the AI Regulation—the author analyzes the Spanish constitutional protection of freedom of expression under Article 20 of the 1978 Constitution and the interpretative role of the Tribunal Constitucional. The study highlights the shortcomings of a national system still focused on repression rather than proactive regulation of the digital sphere and the creative role of courts in adapting traditional principles to online communication. The recent establishment of the Agencia Española de Supervisión de la Inteligencia Artificial (AESIA) is presented as a significant step toward aligning Spain with the European approach to safeguarding fundamental rights in the algorithmic era.
Il contributo analizza la tutela della libertà di espressione online nel quadro giuridico spagnolo, alla luce della disciplina e della giurisprudenza europea. Dopo aver ricostruito l’evoluzione normativa dell’Unione europea — dalla Carta dei diritti fondamentali al Digital Services Act, al Digital Markets Act e al Regolamento sull’intelligenza artificiale — l’autrice esamina la regolazione costituzionale spagnola, evidenziando la centralità dell’art. 20 della Costituzione del 1978 e il ruolo del Tribunal Constitucional nella protezione di tale diritto. Il lavoro sottolinea le criticità di una normativa nazionale ancora prevalentemente repressiva e la funzione creativa della giurisprudenza nel colmare i vuoti regolatori, soprattutto in materia di comunicazione digitale. Particolare rilievo assume la recente istituzione dell’Agencia Española de Supervisión de la Inteligencia Artificial (AESIA), quale strumento di raccordo tra ordinamento europeo e spagnolo.
