Intangible cultural heritage has become an increasingly significant field of inquiry, governed at the international level primarily by the 2003 UNESCO <>. The Italian legal framework, however, still appears markedly incomplete for a number of reasons, despite the comprehensive reform introduced by Law No. 152 of 2024. This article does not aim to define the legal nature of intangible heritage or its precise boundaries. Rather, through the analysis of three case studies, it seeks to highlight the inherent complexity and critical issues surrounding the subject. The cases examined concern the historic lateen-rigged boats of Cesenatico, the various dimensions of soundscapes, and the question of whether the “Sanremo Festival” may legitimately be regarded as intangible cultural heritage. The discussion concludes with critical reflections, including an assessment of the competences of the Ministry of Culture (MIC) in this domain.
