Il legislatore mecenate: la tutela giuridico-penalistica del patrimonio culturale contro le spoliazioni

Premise of the distinction between external and internal spoliation, this contribution examines international treaty law dedicated to the former. If the removal occurs during wartime by an enemy state, cultural property may become both a military target to be destroyed and a war booty to be looted. These aspects are addressed by the 1954 Hague Convention, its 1999 Second Protocol, and the 1971 UNESCO Convention. If, on the other hand, theft and unlawful exportation are carried out by private individuals during peacetime, the applicable instruments are the 1970 UNESCO Convention, the 1995 UNIDROIT Convention, and the 2017 Nicosia Convention. It is precisely the latter that inspired the 2022 Italian reform aimed at combating internal spoliation of artworks, whose strengths and weaknesses will be highlighted. The discussion will conclude by reviewing the organization and activities of the Carabinieri’s Cultural Heritage Protection Unit in the fight against art crimes.

Premessa la distinzione tra spoliazioni esterne ed interne, il contributo esamina la normativa internazionalistica pattizia dedicata alle prime. Se la sottrazione avviene in tempo di guerra da parte di uno Stato nemico il patrimonio culturale potrà divenire tanto obiettivo militare da distruggere quanto bottino di guerra da trafugare: di questi profili si occupano la Convenzione dell’Aja del 1954, il relativo protocollo addizionale del 1999, nonché la Convenzione UNESCO del 1971. Se, al contrario, i furti e le illecite esportazioni vengono perpetrati da privati in tempo di pace, si applicheranno le Convenzioni UNESCO del 1970, UNIDROIT del 1995 e Nicosia del 2017. Proprio quest’ultima ha ispirato la riforma italiana del 2022 a contrasto delle spoliazioni interne di opere d’arte, di cui si evidenzieranno pregi e criticità. Si concluderà quindi la trattazione ripercorrendo organizzazione e attività contro gli art crimes del Nucleo Tutela Patrimonio Culturale dell’Arma dei Carabinieri.
