Madres y padres afines en Cuba. Función asistencial y «pluriparentalidad jerárquizada» en los bordes de la filiación

The new Código de las Familias brings to Cuba an organic regulation of affine parenthood, the relationship between children and step-parent in the reconstituted family. After a brief outline of the constitutional framework, the statute of the affine parent is examined, analysing duties and powers. The subsidiary and complementary role of the affine parent in relation to the family of origin is highlighted, in a manner akin to a form of “hierarchised pluri-parenthood”, to borrow the particularly eloquent formula used by Argentine scholars. The configurations of multi- parenthood introduced by the Cuban legislator encourage a closer examination of the relationship between affine parents and – so to speak – full parents, whether by origin or through subsequent legal attribution, within such scenarios.
