Giuridicità della natura o diritti della natura? Alcune riflessioni sul binomio diritto-natura

This essay reflects on the relationship between law and nature, with particular reference to the recent EU Nature Restoration Law, which seeks to restore degraded ecosystems. It engages with the notion of granting legal rights to nature, examining its philosophical and legal foundations. Drawing on Pietro Costa’s "Il progetto giuridico", the essay traces the historical evolution of key legal concepts such as property and contract, highlighting their role in shaping the human-nature relationship. Rather than merely advocating for the recognition of "rights to nature", the essay proposes the concept of a "juridicity of nature" as a means of overcoming traditional dichotomies between humans and nature and fostering a more inclusive legal paradigm.
