Regolazione e politica industriale nella gestione dei rifiuti: le tariffe di accesso agli impianti

The paper aims to trace the main features of tariff regulation in the waste treatment sector. After having ruled out the possibility that these powers only deal with the public service sphere, the contribution addresses the infrastructural adjustment purpose envisaged by the law establishing Arera. This objective is discussed, also in the light of the most recent case law, as to its ability to introduce significant discretionary powers into the sector’s independent regulation.

L’indagine si propone di ricostruire i caratteri della regolazione tariffaria nel settore dei rifiuti, con particolare riferimento alle tariffe di accesso agli impianti di trattamento. Una volta esclusa la riconducibilità di tali potestà al solo ambito del servizio pubblico, il contributo si sofferma sull’obiettivo dell’adeguamento infrastrutturale, previsto dalla legge istitutiva dell’Arera. Di tale finalità è discussa, anche alla luce della più recente giurisprudenza, l’attitudine a introdurre rilevanti elementi discrezionali nella regolazione indipendente di settore.
