Potere costituente e fatti normativi. Oltre i miti della permanenza e dell’assenza

In this essay, I focus on some aspects of the concept of constituent power defended by Jorge Baquerizo, to stress their relevance for our understanding of such power. I focus, in particular, on the ‘complexity’ of normative facts – that lies at the core of that concept – to highlight that it serves as the basis of a deeper analysis of the concept of constituent power, which can capture and address therelationship between that concept and the concept of constituent process as well as the temporal dimension of this relation, which is extremely relevant in both descriptive and normative terms.
