The Commission brought an infringement action against Poland concerning the infamous judgments of the Polish Constitutional Tribunal in cases P7/20 and K3/21 of 2021. Based on the Opinion by AG, the contribution argues that in its future ruling the ECJ should clarify the concept of constitutional identity and take a firm stance vis à vis the rejection of the principle of primacy by domestin constitutional courts.
