The author examines the appeals’ selection methods before the italian supreme Court, alongside with a comparative analysis to the newly spanish access criterion, so called « interés casacional ». This paper aims to suggest a possible rethinking of the italian system, not only with a hypothetical constitutional reform but also with the unchanged constitution.
