I nuovi strumenti di prevenzione della corruzione: ambito giuridico soggettivo e indicatori di rischio

The article highlights the innovation of the most markedly preventive approach to the fight against corruption introduced in Italy by Law no. 190 in 2012, in accordance with international and supranational initiatives. Focusing on the national level, the document underlines how the preventive purpose characterizes as much the evolution of the bodies appointed to fight corruption, up to the current ANAC, as the identification of measurement tools not only of the existing corruption but, above all, of the risk of the occurrence of corruptive episodes. Always with the aim of enhancing the preventive aspect of the provisions, the article refers to the regulations relating to administrative liability as per Legislative Decree no. 231 of 2001 and emphasizes the guiding role played by ANAC through the issue of specific guidelines which classify the obligations to be fulfilled by the institutions according to the institutions type.
