When the substantive claims do not engage national (or EU) law, the arbitral Tribunal will only determine whether the Respondent breached the ECT. The Umbrella Clause covers only contractual obligations. States retain the right to introduce regulatory changes in the public interest, as long as changes are proportionate and not radical.
