I beni culturali di interesse religioso nell’ordinamento italiano

The paper first of all discusses the birth and establishment of the expression cultural heritage of religious interest in Italian law”. It then addresses the “dating back issues” over time concerning these assets: interpretation of the art. 9 of Legislative Decree 42/2004; notion of cultural property of religious interest; scope of the principle of collaboration in this matter between the State and religious denominations; cultural assets of religious interest as res mixtae. Finally, the “challenges of the present” are mentioned: digitalization and reproduction; intangible cultural heritage; link between cultural heritage and landscape heritage; financing; permanence of the “artistic legibility” of the cultural asset of cultural interest in the younger generations.
