Mixed agreements in the Italian legal order

The contribution investigates the ways and means of the Italian participation to the negotiation, conclusion and ratification of EU mixed agreements, and their reception into the Italian legal order. By presenting and assessing the recent constitutional practice, the contribution analyses in particular the evolution of the balance of power between the legislative and executive powers in this field, and how it may contribute to limiting the legal downsides of facultative mixity.

Il contributo analizza la partecipazione dell'Italia alla negoziazione e ratifica degli accordi misti e il loro recepimento nell'ordinamento giuridico italiano. Si mette in luce, in particolare, l'evoluzione del bilanciamento tra potere esecutivo e legislativo in questo campo e il possibile contributo della prassi costituzionale e parlamentare italiana alla risoluzione dei principali limiti giuridici derivanti dalla facultative mixity.
