Presentazione

Opening the reflections that arose on the occasion of the fortieth anniversary of the promulgation of the Codex Iuris Canonici, which populate the volume, this Presentation retraces the essential stages of the path that, starting from the immediate post-council and despite the resistance sometimes encountered, finally led to the adoption of the Code currently in force for the Latin Church. It is a story, the one of the developments of the ius Ecclesiae, to which not even the University of Bologna appears extraneous: not only regarding the last four decades, but in relation to a tradition that has its roots in the apogee of medieval Canon Law, unmistakably marked by a link between doctrine and legislation that it is not superfluous to recall even today.

Ponendosi in apertura delle riflessioni scaturite in occasione del quarantesimo anniversario della promulgazione del Codex Iuris Canonici che popolano il volume, la Presentazione ripercorre le tappe essenziali del percorso che, a partire dall'immediato post-concilio e nonostante le resistenze talora incontrate, hanno infine portato all'adozione del Codice attualmente vigente per la Chiesa latina. Si tratta di una storia, quella degli sviluppi dello ius Ecclesiae, rispetto alla quale l'Università di Bologna non risulta estranea: e non certo limitatamente agli ultimi quattro decenni, bensì in rapporto a una tradizione che affonda le radici fin nell'apogeo della canonistica medievale, inconfondibilmente contrassegnata da un legame tra dottrina e legislazione che non è superfluo rievocare ancora oggi.
