Dai beni comuni al benessere comunitario. Evidenze, incertezze e limiti di un concetto sotto osservazione

This essay begins by presenting the project that led to the publication of this volume and then proceeds to discuss the various "structuralist" and "functionalist" theories that have attempted to provide a theoretical framework for the category of common goods. Both approaches are driven by dissatisfaction with the public/private dichotomy and, despite their different aims, ultimately engage with the role of public administration, which is invariably tasked with regulating and deciding what should be allocated to respective legal regimes. The essay then proposes an interpretation of common goods based on the theory of interests, which successfully integrates both the subjects and the relational dynamics involved. The discussion thus shifts from the concept of common goods, an inevitably elusive category from an exegetical perspective, to that of "community well-being," focusing on the needs of community members and the regulatory forms necessary to ensure their optimal satisfaction.

Il presente saggio, dopo aver presentato il progetto che ha portato alla pubblicazione del volume, inizia discutendo le diverse teorie “strutturaliste” e “funzionaliste” che hanno tentato di dare inquadramento teorico alla categoria dei beni comuni. Mosse entrambe dall’insoddisfazione dell’alternativa pubblico/privato, pur con intenti diversi, finiscono per discutere del ruolo dell'amministrazione pubblica, chiamata comunque a un ruolo di regolazione e scelta su cosa sia destinato ai rispettivi regimi giuridici. Si propone quindi un'interpretazione dei beni comuni fondata sulla teoria degli interessi, la quale riesce a tenere assieme i soggetti e le dinamiche relazionali. Si giunge così a discutere non tanto dei beni comuni, categoria inevitabilmente evanescente dal punto di vista esegetico, ma del “benessere comunitario”, focalizzandosi sui bisogni dei membri di una comunità e delle forme di regolazione necessarie ad assicurare la loro migliore soddisfazione.
