Nello spirito del tempo. L’influenza della cultura sull’evoluzione del sistema giuridico istituzionale

The rules that shape our coexistence are not only an expression of power, but also and perhaps first of all the manifestation of time in which they are generated, the cultural and social climate in which they are conceived to which, from time to time, they listen or oppose. In these terms, the law is in itself a cultural product, the testimony of a feeling widespread which, in turn, becomes an essential exegetical key and, albeit with difficulty, force of innovation or resistance. These pages draw some of these references by looking for motions from the Risorgimento to today, the interactions between a society in constant evolution and the "constitutional feeling", between what literature, theatre, cinema, the television or the network have tell of their time, and what comes, in at the same time, codified.

Le regole che danno forma alla nostra convivenza sono non soltanto un’e- spressione di potere, ma anche e forse prima di tutto la manifestazione del tempo in cui si generano, del clima culturale e sociale in cui sono concepite a cui, di volta in volta, danno ascolto o si oppongono. In questi termini, il diritto è in se stesso un prodotto culturale, la testimonianza di un sentire diffuso che, a sua volta, ne diventa chiave esegetica essenziale e, pur a fatica, forza di innovazione o di resistenza. Queste pagine disegnano alcuni di questi rimandi cercando, dai moti risorgimentali a oggi, le interazioni tra una società in evoluzione costante e il “sentire costituzionale”, tra ciò che la letteratura, il teatro, il cinema, la televisione o la rete hanno raccontano del loro tempo, e ciò che viene, nel tempo stesso, codificato.
