La natura recettizia della rinuncia all'ufficio petrino. Una lettura sistematica nella cornice del diritto canonico vigente

The contribution analyzes a particular aspect of the resignation of the Roman Pontiff, namely its receptive nature (knowability), which safeguards the freedom of the renouncer and the certainty of the law. Furthermore, the pontifical resignation is compared with the discipline of renunciation with acceptance provided for in the Code of Canon Law, and then finally focuses on the problems inherent in the relationship between the 'conditional' resignation and the institution of the totally impeded Roman see.

Il contributo analizza un particolare aspetto della rinuncia all’ufficio di Romano Pontefice, ossia la sua natura recettizia (conoscibilità), che salvaguarda la libertà del rinunciante e la certezza del diritto. Inoltre, si mette a confronto la rinuncia pontificia con la disciplina della rinuncia con accettazione prevista nel Codice di Diritto Canonico, per poi infine concentrarsi sulle problematicità insite nella relazione tra la rinuncia ‘condizionata’ e l’istituto della sede romana totalmente impedita.
