I matrimoni ʻmistiʼ tra diritti religiosi e diritti secolari

‘Mixed Marriages’ between Religious Laws and Secular Laws. The essay examines, in parallel and in comparison, the rules through which different religious legal systems (namely Jewish, Muslim, Canon, Hindu and Buddhist laws) regulate marriages between their faithful and partners who profess a different faith. A focus is also dedicated to current interpretative and applicative approaches, which translate the different ways through which religious laws, being tendentially rigid and unchangeable, aim to face the challenge of the multiplication of ‘interreligious marriages’ linked to globalization and to the great mobility of people.

Il contributo esamina in parallelo e in comparazione tra loro i precetti che diversi diritti religiosi (segnatamente il diritto ebraico, islamico, canonico, induista, buddista) riservano ai matrimoni di loro fedeli con partners di altri culti. Ci si sofferma inoltre sugli orientamenti interpretativi e applicativi attuali, i quali traducono le distinte modalità attraverso cui i diritti confessionali, tendenzialmente rigidi e immodificabili, mirano a rispondere alla sfida della moltiplicazione dei ʻmatrimoni interreligiosiʼ legata alla globalizzazione e alla grande mobilità delle persone.
