Il matrimonio nell'induismo, nel buddismo e nel sikhismo

Today, the concept of 'family' itself seems to be placed at the crossroads of continuous debates, which catalyze the gazes of scholars from the most different disciplines as well as those of the general public. Such an interest reflects the width of the theme and its aptitude to captivate any observer, being it a topic in which everyone feels deeply involved. In front of such developments, it is clear that the legal sphere cannot remain indifferent. On the contrary, more and more often it finds itself in the need to chase two opposite lines of flight: on the one hand, the constantly changing one that is outlined by the social changes of contemporary societies; on the other hand, the apparently immutable one of which every confessional and cultural tradition considers itself to be the bearer. If this scenario poses a challenge for secular legal systems, the same is even truer for religious laws, which always reserve great attention to the family. It is for these reasons that the volume aims to provide an overall picture of the different levels of reading that come into play, by describing the legal disciplines that are outlined in matrimonial matters by the different religious traditions in the general part and then by addressing the most relevant and delicate profiles emerging in current circumstances in the special part. Specifically, this essay focuses on the institution of marriage as regulated by the main 'dharmic religions': after investigating the precepts emerging on the subject from classical Hindu law and the trends found in the current legislation of the Republic of India, the attention therefore shifts to the concept of the marital bond within Sikhism and Buddhism, both from the perspective of each legal system and in comparison with each other.

Il concetto di 'famiglia' si colloca oggi al crocevia di dibattiti incessanti, che catalizzano gli sguardi dei cultori delle discipline più diverse così come quelli del grande pubblico: un interesse nella cui ampiezza si riflette la trasversalità del tema e la sua capacità di appassionare qualsiasi osservatore, toccando esso le corde più intime di ogni individuo. Rispetto a simili rivolgimenti, chiaramente non può restare indifferente neppure la sfera giuridica, nella quale ci si trova anzi sempre più spesso a dover inseguire due linee di fuga opposte: da un lato quella costantemente cangiante dei mutamenti sociali prospettati dalla contemporaneità, dall'altro quella apparentemente immutabile di cui ciascuna appartenenza confessionale e culturale si fa portatrice. Se ciò appare come una sfida per i diritti secolari lo stesso vale a maggior ragione per gli stessi diritti religiosi, che proprio alla famiglia riservano un’attenzione irrinunciabile. È per queste ragioni che il volume si propone di fornire un quadro complessivo dei diversi piani di lettura che entrano in gioco, dando conto nella parte generale delle discipline giuridiche delineate in materia matrimoniale dalle diverse tradizioni religiose e affrontando poi in quella speciale i profili più rilevanti e delicati che si manifestano nell'attualità. Segnatamente, il presente contributo si sofferma sull'istituto matrimoniale così come regolato presso le principali 'religioni dharmiche': dopo avere indagato i precetti emergenti in materia dal diritto indù classico e le linee di tendenza riscontrabili nell'odierna legislazione della Repubblica dell'India, ci si sofferma quindi sulla concezione del vincolo coniugale all'interno del sikhismo e del buddismo, sia nell'ottica di ciascun ordinamento sia in comparazione l'uno con l'altro.
