Law in the History of the Church. Lectures The ‘lenses’ of law through which the first one-thousand-three-hundred years of history of the Catholic Church are analyzed in this book turn out to be particularly penetrating in order to illustrate the extraordinary evolution of the canonical legal system to University students in Legal Sciences and, thus, to fully understand topics that are also vividly debated in the current ecclesial context (the role of lay faithful and women, clerical celibacy, the contractual and sacramental qualification of marriage, etc.). But the same lenses also allow to explore the roots of many institutions of which State legal systems make use still today: as well as the social, political and intellectual developments of which they were the fruit or the cause. In the end, suggestive glimpses into fundamental and usually lesser-known aspects of the evolutionary parable of the Christian West open up even for readers who are not law experts.

Gli ʻocchialiʼ del diritto con i quali, in questo libro, vengono analizzati i primi milletrecento anni della storia della Chiesa cattolica si rivelano essere particolarmente penetranti per illustrare agli studenti universitari di scienze giuridiche la straordinaria evoluzione dell’ordinamento canonico e, così, comprendere appieno pure tematiche vivacemente dibattute nel contesto ecclesiale odierno (il ruolo del laici e quello delle donne, il celibato ecclesiastico, la qualificazione contrattuale e sacramentale del matrimonio, ecc.). Ma quegli stessi occhiali consentono altresì di esplorare le radici di numerosi istituti di cui ancora oggi i sistemi normativi statuali si avvalgono: nonché degli sviluppi sociali, politici e del pensiero di cui sono stati il frutto oppure la causa. Aprendo infine, anche per il lettore non esperto di diritto, squarci suggestivi su profili fondamentali e spesso poco noti della parabola formativa dell’Occidente cristiano.
