The normative value of Roman law in Mixed Legal Systems. Scotland and South Africa have a ‘hybrid’ or ‘mixed’ legal system no codified, formed by interweaving of a number of distinct legal traditions: a civil law system inherited from the Roman law with the English influence most apparent in procedural aspects and methods of adjudication. The essays analyzes contents and methods of application of Roman law and ius commune by Scottish and South African judges and stresses the contemporary influence of the civil law in these mixed systems

La nazione scozzese e lo Stato sudafricano sono caratterizzati da un sistema giuridico misto o ibrido, formato da distinte tradizioni giuridiche: il civil law ereditato dal diritto romano con influenza del diritto inglese nel diritto processuale. Il saggio analizza contenuti e metodi di applicazione del diritto romano e del ius commune da parte dei giudici scozzesi e sudafricani e sottolinea la contemporanea influenza del civil law nei sistemi misti.
