Dalla sede totalmente impedita alla sede vacante: l'ufficio di Cardinale Camerlengo dopo la costituzione apostolica Praedicate Evangelium

Thinking about the vacancy of the Apostolic See, one of the first figures that inevitably appears not only in the speculations of scholars, but also in collective imagination, is the Cardinal Camerlengo. In consideration of his fundamental functions during the vacancy, even the Proposal for an apostolic constitution on the entirely impeded Roman See, which was recently drafted by a group of canonists from different countries with the aim of facilitating an orderly and prudent transition from the latter to the former situation, suggests to entrust him with central tasks, such as the activation of the procedures in case of personal incapacity of the Roman Pontiff. When referring to the role of the Camerlengo, however, it is now essential to also take into account the innovations that have occurred in the meantime with the promulgation of the Apostolic Constitution Praedicate Evangelium, in light of which some questions also appear unavoidable. In fact, while not confirming the automatic assignation of such office to the Cardinal Coordinator of the Council for the Economy, which was anticipated in the unofficial draft that had been previously circulating, the new provisions still produced significant innovations: starting with the suppression of the Apostolic Camera, the functions of which have been retained by the Cardinal Camerlengo, who cannot but rely on an external support for their fulfilling. One can also recognize some inconsistencies, both within the new provisions and in their coordination with the special legislation on the vacancy of the Apostolic See, which therefore require an appropriate evaluation: as it is the case of the aforementioned Cardinal Coordinator of the Council for the Economy, who now permanently replaces one of the – ordinarily selected by lot – members of the Particular Congregation that is mentioned in n. 7 of the Apostolic Constitution Universi Dominici Gregis, although he should theoretically cease from his office precisely when the Apostolic See is vacant, according to art. 18 § 1 of Praedicate Evangelium. Considering these innovations and in the perspective of the further functions suggested by the above-mentioned proposal, this essay aims to analyze the implications of the renewed office of Cardinal Camerlengo, with regard both of its inner dynamics and of its relations with the other institutions of the Roman Curia.

Volgendo la mente alla situazione di vacanza della sede apostolica, una delle prime figure a profilarsi non solo nella ricostruzione del canonista, ma pure nell'immaginario collettivo, è senz'altro quella del Cardinale Camerlengo: in considerazione delle funzioni che questi svolge, anche il Progetto di costituzione apostolica sulla sede romana totalmente impedita recentemente presentato da un gruppo di studiosi di diversi Paesi, che dall'una all'altra situazione intende dichiaratamente favorire il transito ordinato e prudente, ha inteso affidare compiti centrali: a partire dall'iniziativa in caso di incapacità personale del Romano Pontefice. Nel riferirsi al ruolo svolto dal Camerlengo, è tuttavia oggi indispensabile fare altresì i conti con le innovazioni nel frattempo intervenute a opera della costituzione apostolica Praedicate Evangelium, alla luce delle quali si presentano come ineludibili anche alcuni interrogativi. Le nuove disposizioni, pur non realizzando l’automatica attribuzione di detto ufficio al Cardinale Coordinatore del Consiglio per l'economia che era stata ventilata nelle bozze precedentemente circolate, non hanno infatti mancato di apportare novità di peso: ad iniziare dalla soppressione della Camera apostolica, le cui funzioni sono tuttavia state mantenute dal Cardinale Camerlengo, inevitabilmente destinato a fare affidamento su sostegni esterni. Né mancano talvolta incongruenze interne alla norma e nel coordinamento con la legislazione speciale sulla vacanza della sede apostolica, che richiedono dunque un'adeguata valutazione: qual è il caso del già citato Cardinale Coordinatore del Consiglio per l'economia, che viene a sostituire stabilmente uno dei membri estratti a sorte nella composizione della Congregazione particolare di cui al n. 7 della costituzione apostolica Universi Dominici Gregis, ma che, a norma dell'art. 18 § 1 della Praedicate Evangelium, dovrebbe teoricamente decadere dall'incarico proprio in situazione di sede vacante. Nell'ottica di queste novità e nella prospettiva delle ulteriori funzioni contemplate dal progetto menzionato, il presente contributo si propone quindi di scandagliare le implicazioni del rinnovato ufficio di Cardinale Camerlengo, sia nelle sue dinamiche interne sia nei suoi rapporti con le altre istituzioni della Curia romana.
