Experiments of “synodality” in the legislative function of the Church: the initiative of canonical science. The essay dwells in the first place on the term ‘sinodality’, by recalling some acute theories from authoritative canonical schools and by pointing out the ambiguities that currently seem to mark it. Today, by the will of Pope Francis, sinodality has to be placed at the heart of the life of the Church, giving it a powerful promotional impulse: a sinodality which is understood mainly as mutual listening, wide consultation, constant cooperation and shared decision-making participation of all members of the people of God. In the light of this ambitious program of ecclesial renewal, the essay meditates on the possible translations of sinodality especially in the normative activity of the Church, on a clear impasse on the present day: with the aim of outlining some possible routes through which legal science could and should actively and fruitfully cooperate to the legislative function, by sharing its set of knowledge and skill. A recent academic project, the purpose of which was to answer effectively and concretely to this ‘call to sinodality’ in such a peculiar field, is then described.
Il saggio si sofferma anzitutto sul significato del lemma ‘sinodalità’, evocando alcune acute teorizzazioni di autorevoli scuole canonistiche e segnalando le ambiguità che attualmente paiono contrassegnarlo. Oggi, per decisa volontà di Papa Francesco, la sinodalità deve porsi al cuore della vita della Chiesa, imprimendole un potente impulso promozionale: una sinodalità intesa principalmente come ascolto reciproco, ampia consultazione, assidua collaborazione, compartecipazione decisionale di tutti i membri del popolo di Dio. Alla luce di questo ambizioso programma di rinnovamento ecclesiale, il contributo riflette sulle possibili traduzioni della sinodalità in particolare nell’attività normativa della Chiesa, oggi in evidente impasse: mirando a delineare alcuni possibili itinerari attraverso i quali la scienza giuridica potrebbe e dovrebbe attivamente e proficuamente cooperare alla funzione legislativa, mettendo a disposizione il proprio bagaglio di conoscenza e di tecnica. Si illustra quindi un recente progetto accademico che si è prefisso di rispondere efficacemente e concretamente a questa ‘chiamata alla sinodalità’ in tale peculiare settore.
