The reasons behind the attention that has surrounded the Sovereign Military Order of Malta in recent years can be understood quite easily: in fact, an institution that was already bound to stand out both in the eye of the contemporary world (which often sees it as a curious but intriguing anachronism) and on the stage of the international community (on which it acts consistently, notwithstanding its undoubtedly sui generis characteristics) could not but attract the widest interest once it found itself at the center of events as turbulent as the ones it experienced in 2016, which finally led to the overall reform of its Constitution and Code. Such a comprehensible curiosity, however, has often been misguided: not only because of the 'sensationalist' approach adopted by the media, but also as a consequence of considering the Order as separate from its history and its constitutive relations. In this sense, the monograph aims to address the major themes arising from the 2022 legislative renewal (namely, the recurring doubts about the sovereignty of the Order and its relationship with the Holy See) in the light of the different dimensions involved: which means by retracing the hundreds-year developments in which such sovereignty and relationship find their roots; by taking into account the presence of the Order in the international community and its recognition according to the different views expressed in International Law; by examining the new legal system of the Order as emerging from the current Constitution and Code. In this regard, the volume focuses on most relevant – and debated – issues affecting both the inner and the international condition of the Order: therefore starting with the new provisions about its Grand Master, and its connection with the Pope and Canon Law.
Le cause dell'attenzione che ha circondato il Sovrano Militare Ordine di Malta negli ultimi anni appaiono facilmente intuibili: un'istituzione già destinata a non poter passare inosservata agli occhi del mondo contemporaneo (che spesso guarda ad essa come a un curioso ma suggestivo anacronismo) né sullo scenario della comunità internazionale (sul quale opera stabilmente, nonostante caratteristiche senz'altro sui generis) non poteva infatti che attrarre il più ampio interesse nel momento in cui è venuta a trovarsi al centro di eventi tanto turbolenti quanto quelli sperimentati nel 2016, che hanno infine portato a una riforma complessiva della Costituzione e del Codice melitensi. Tale comprensibile curiosità, tuttavia, si è rivelata spesso mal direzionata: e ciò non solo per l’approccio 'scandalistico' adottato dai media, ma anche come conseguenza della tendenza a considerare l'Ordine quale separato dalla sua storia e dalle sue relazioni costitutive. In questo senso, la presente monografia si propone di affrontare i principali temi emergenti dal rinnovamento legislativo del 2022 (specificamente gli interrogativi ricorrenti circa la sovranità dell'Ordine e il suo rapporto con la Santa Sede) alla luce delle diverse dimensioni coinvolte: vale a dire ripercorrendo gli sviluppi plurisecolari in cui tale sovranità e tali relazioni affondano le proprie radici; prendendo in esame l'attuale presenza dell'Ordine nella comunità internazionale e il suo riconoscimento secondo i differenti punti di vista espressi dalla dottrina internazionalistica; analizzando il nuovo ordinamento melitense così come modellato dalla Costituzione e dal Codice vigenti. A questo proposito, il volume si concentra sui profili più rilevanti – e dibattuti – che inevitabilmente investono tanto la condizione interna quanto quella internazionale dell'Ordine: a partire quindi dalle nuove disposizioni relative al suo Gran Maestro e dal legame con il Papa e il diritto canonico.
