For a cooperation of Canon Law science in ecclesial law-making: namely about the impeded Roman See and the Pope who resigned The essay retraces the phases of the project that was started by an international group of Canon Law scholars. In particular, after identifying two problematic topics about which there is a legislative gap that today needs to be filled – the one regarding the legal status of the Roman Pontiff who resigned and the one regarding the regulation of the entirely impeded Roman See –, two law proposals were drafted. Then, they were published on an interactive multimedia platform in order to collect opinions and suggestions by the whole Canon Law science. In addition to the specific content of the projects, the aim pursued consists in identifying and outlining a methodology for the drafting of canon laws which includes the cooperation of the universal legal science: with the purpose of helping the supreme legislator of the Church in the difficult work of preparing canon laws which, even before being technically flawless, are consistent with justice.

Il saggio ripercorre le tappe del progetto avviato da un gruppo internazionale di canonisti. Identificati, in particolare, due ambiti problematici sui quali esiste oggi una lacuna normativa da colmare - quello dello status giuridico del romano pontefice che ha rinunciato, nonché quello della regolazione della sede romana totalmente impedita - sono stati elaborati due progetti di legge. Essi sono poi stati pubblicati in una piattaforma multimediale interattiva per raccogliere opinioni e suggerimenti da parte dell’intera scienza canonistica. Oltre i contenuti specifici, lo scopo perseguito è quello di identificare e delineare una metodologia di redazione delle norme canoniche che contempli la collaborazione della scienza giuridica universale: al fine di ausiliare il legislatore supremo della Chiesa nella difficile opera di predisporre leggi canoniche, ancor prima che tecnicamente ineccepibili, coerenti a giustizia.
