The article is aimed at analysing some characteristics of the Brazilian constitutional system, as set out in the first article of the 1988 Constitution, and at highlighting the limits imposed on the legislation and, in general, on politics. In particular, with a comparative law perspective, the article focuses on the federal nature of the Brazilian legal order, on its essence as a democratic state of law, and on the foundations of the Republic, namely sovereignty, citizenship, human dignity, labor social values and free entreprise, political pluralism.
