Going beyond the mere use of AI technologies in a "predictive" sense, the contribution investigates the potentiality of a different approach, also from a defensive point of view, which can be developed starting from certain artificial intelligence systems known as Multi-Agent Systems. After a brief reconnaissance of the principal characteristics of this technology, it will be stated, first of all, how such instruments are already proving to be an essential support in certain investigative segments, especially in the face of the challenges posed by the management of big data. MAS technology, however, has much more revolutionary profiles for the (re)definition of the investigative paradigms within the criminal trial. In particular, the contribution suggests how these tools (and especially some specific applications, such as the MultiAgent Digital Investigation Toolkits) could prove to be a formidable tool to expand the notion of fairness, and therefore the protection of the rights of defence, already in the investigation phase. In fact, such tools could help to avoid, or at least reduce, some typically human errors in investigation processes, which are often the cause of real miscarriages of justice, such as the so-called tunnel vision effect.

Andando oltre la proposizione di tecnologie IA in senso "predittivo", il contributo indaga sulle potenzialità di un diverso approccio in ottica anche difensiva, sviluppabile a partire da alcuni sistemi di intelligenza artificiale noti come Multi-Agent System. Dopo una breve ricognizione delle principali caratteristiche di questa tecnologia, si dirà innanzitutto come tali strumenti si stiano già dimo-strando un supporto essenziale in taluni segmenti investigativi, specie a fronte delle sfide poste dalla gestione dei big data. La tecnologia MAS, tuttavia, presenta in nuce profili ben più rivolu-zionari per la (ri)definizione dei paradigmi investigativi all’interno del processo penale. Nel contributo, in particolare, si suggerisce come questi strumenti (e soprattutto alcune applicazioni specifiche, come i MultiAgent Digital Investigation Toolkits) potrebbero rivelarsi uno strumento formidabile per ampliare la nozione di fairness, e quindi la tutela dei diritti di difesa, già nella fase delle indagini. Tali strumenti potrebbero infatti contribuire ad evitare, o almeno a ridurre, alcuni errori tipicamente umani dei processi investigativi, spesso causa di veri e propri errori giudiziari, come il cosiddetto tunnel vision effect.
