Il dicastero ‘promotore, garante e interprete del diritto nella Chiesa’: per una valorizzazione dei consultori

The ‘upholder, guarantor and interpreter of the Church’s law’ dicastery: for a valorization of the consulters The essay moves from the observation of the evident impasse experienced by the normative season currently underway in the Catholic Church. After identifying and examining some of the reasons of such a situation of difficulty, we bring forward the proposal of a new way for the urgent revalorization of the Pontifical Council for Legislative Texts in order to overcome critical issues. By renewing methodologies and work structures, the dicastery must represent more and more the hinge of a ‘synodal legislative activity’, thus becoming the upholder and promoter of a wide-ranging consultation that fruitfully involves the responsibility of the whole Canon law science.

Il saggio muove dalla constatazione dell’evidente impasse sperimentata dalla stagione normativa attualmente in atto nella Chiesa cattolica. Identificate ed esaminate alcune delle ragioni di tale situazione di difficoltà, si avanza la proposta di una nuova modalità per l’urgente rivalorizzazione del Pontificio Consiglio per i testi legislativi al fine di superare le criticità. Tale dicastero, rinnovando metodologie e strutture di lavoro, deve rappresentare sempre più il fulcro di un’‘attività normativa sinodale’, divenendo animatore e promotore di una consultazione a largo raggio che coinvolga fecondamente la responsabilità dell’intera scienza canonistica.
