The essay analyzes the history and contradictions of the politics of human rights since the Declaration of 1789. In particular, it analyzes the social significance of the reference to human rights as a substitute for political action. Particularly in the neoliberal era, human rights become the only and almost the only way to compensate an exclusion that is completely individualized. By analyzing the positions of authors such as Habermas, Luhmann, Arendt, Lefort, Gauchet, Balibar, Brown and Spivak, the essay shows the limits of the politics of human rights and, by resorting to the most recent German philosophy of law, suggests that they can no longer be separated from social rights, nor can they be merely considered as an expression of subjective rights in opposition to objective law.

Il saggio analizza la storia e le contraddizioni della politica dei diritti umani a partire dalla Dichiarazione del 1789. Viene in particolare analizzato il significato sociale del riferimento ai diritti umani quali sostituti dell'azione politica. In particolare nell'epoca neoliberale i diritti umani diventano la sola e pressoché unica modalità di risarcire un'esclusione che viene completamente individualizzata. Analizzando le posizioni di autori quali Habermas, Luhmann, Arendt, Lefort, Gauchet, Balibar, Brown e Spivak il saggio mostra i limiti della politica dei diritti umani e, facendo ricorso alla più recente filosofia del diritto di lingua tedesca, suggerisce che essi non possono più essere separati dai diritti sociali e nemmeno possono essere meramente considerati come espressione di diritti soggettivi in opposizione al diritto oggettivo.
