LA DICHIARAZIONE UNIVERSALE DEI DIRITTI UMANI E LA PROTEZIONE E PROMOZIONE DEI DIRITTI DEI MINORI

The Universal Declaration of Human Rights and the Protection and Promotion of the Rights of the Child. – The Universal Declaration of Human Rights (adopted in 1948 by the United Nations General Assembly) enumerates few – but meaningful – principles specifi-cally concerning children. These principles have led to the first set of rights, that little by lit-tle have been confirmed and specified in other international instruments, such as the 1959 Declaration on the Rights of the Child and later the two 1966 International Covenants, in addition to other universal and regional conventions and documents. The rights of the child have soon gained a core role in the general frame of international human rights law when the 1989 United Nations Convention on the Rights of the Child was adopted and then en-tered into force. Indeed, this Convention has attested the transition from the protection of children, qualified as particularly vulnerable persons, to the full recognition of children as individuals who have human rights evolving with the progression of their age and maturity.

La Dichiarazione universale adottata nel 1948 dall’Assemblea generale delle Nazioni Unite contiene poche, ma significative, disposizioni riguardanti specificatamente i minori che hanno costituito un primo nucleo di diritti, via via riconfermati e specificati in strumenti successivi, quali la Dichiarazione dei diritti del fanciullo del 1959, e presi in conto e riaffermati nei Patti delle Nazioni Unite del 1966 e in altri testi sia a tendenza universale sia a portata regionale. La progressiva affermazione dei diritti dei minori ha assunto un ruolo centrale nel più generale quadro della protezione internazionale dei diritti umani con l’adozione della Convenzione delle Nazioni Unite del 1989 sui diritti del fanciullo, che certifica il passaggio dalla protezione dei minori quali soggetti particolarmente vulnerabili al pieno riconoscimento del loro status di indi-vidui titolari di diritti connessi a necessità e prerogative che si evolvono con l’evolvere dell’età e della maturità.
