Mercato unico dei servizi e tutela del lavoro nell’Unione Europea: convergenze e interferenze

Based on an analysis of the scope and consequences of the core freedoms of establishment and of provision of services guaranteed by the Treaty on the Functioning of the European Union, this paper focuses on some of the related labour law implications. In particular, a favorable opinion is expressed on the two recent European directives on the transnational posting of workers; a mainly favorable view is expressed on the European discipline of recognition of professional qualifications; and a critical opinion is expressed on the unresolved problems raised by the well-known case law of the Court of Justice of EU on the relationship between the two entrepreneurial core freedoms and the right to strike.
