The article focuses the current moment of passage of the canon law, so tricky for cfor the novelties introduced by Pope Francis. The structure of the marriage process, some areas of criminal law, the relationship between the universal church and the local church, to consider some examples, are changing profoundly. The work of the legislator does not always appear clear and sure: and the contribution of a courageous and critical doctrine would be desirable. To go in this direction, however, says this contribution, it is necessary that canonistic science is authoritative and credible: and, at this moment, it is not always so.

L’articolo illustra l’attuale momento di passaggio del diritto canonico chiamato in causa dalle novità introdotte da Papa Francesco. La struttura del processo matrimoniale, alcuni ambiti del diritto penale, il rapporto tra chiesa universale e chiesa locale, per stare a qualche esempio, stanno mutando profondamente. L’opera del legislatore non appare sempre chiara e sicura: e il contributo di una dottrina coraggiosa e critica sarebbe auspicabile. Per andare in questa direzione, afferma però questo contributo, bisogna che la scienza canonistica sia autorevole e credibile: cosa che non sempre si riscontra nella realtà.
