The book chapter aims to investigate the interpretation given to Article 14 of the European Convention on Human Rights by the European Court of Human Rights when sexual minorities are at stake. It argues that, after having reached significant substantive and procedural standards, the European Court seems to draft a new approach in relation to this minority group based on the notion of vulnerability and of "intrinsic value" of protected rights for people at stake, "in addition to" the role given to them by contracting States.

Abstract

The book chapter aims to investigate the interpretation given to Article 14 of the European Convention on Human Rights by the European Court of Human Rights when sexual minorities are at stake. It argues that, after having reached significant substantive and procedural standards, the European Court seems to draft a new approach in relation to this minority group based on the notion of vulnerability and of "intrinsic value" of protected rights for people at stake, "in addition to" the role given to them by contracting States.
