La responsabilidad patrimonial de la administración por una deficiente asistencia sanitaria

Patrimonial liability has a very marked objective character when referring to health services, but when it comes to the judicial assessment, it is not easy to establish the relation of causality between the action of health staff –lex artis– and the final result. At the end, it is the judge entire jurisdiction to recognize the existance of a causal link: these disturbing signs can bring into question the fragility of the liability concept in the health industry, a system built to be theoretically perfect but that, sometimes can lead to unfair results.
