The article focuses on the distinction between legislative and non legislative acts in the Constitutional Treaty. In particular, the first part analyzes the various EU sources mentioned in the Constitutional Treaty underlining their main characteristic, virtues, limits and differences with regard to the current system. The second and central part, instead, concentrates on how the normative framework contained therein may have affected the way in which certain crucial areas of EU law have evolved in past and recent years. Finally, the third part attempts preliminary assessment of the possible future legal framework in the light of recent developments following the European Council meeting which took place in Brussels on the 21 and 22 of June 2007.
