Much has been written about the resignation of the Pope Benedict XVI. We have witnessed this historical event during the ordinary public consistory of 11 February 2013: but still today the horizon is still clouded and confused. Therefore it’s appropriate and useful to produce an accurate reconstruction of the canonical boundaries of abdication, fixed in canon 332 § 2 of the Code of Canon Law for the Latin Church, in the canon 44 § 2 of the Codex Canonum Ecclesiarum Orientalium, as well also in the norms of Apostolic Constitution Universi dominici gregis (1996) regarding the vacancy of the Apostolic See and the election of Roman Pontiff. The first chapter of the book is devoted to a consideration of the Pope’s waiver in the Church. This dynamic is very complex and winds between the power of order and of jurisdiction. The second one focuses on a thorough analysis of the cause, in juridical terms, of the renuntiatio. This element, in fact, was greatly misunderstood and misinterpreted, reducing the cause of resignation only to old age. This leads to proposals unacceptable into the ius Ecclesiae (like the attempt to introduce a sort of temporary papacy). After have focused the attention on legal adequacy, freedom, publicity and effectiveness of the waiver, the book takes into account the status of the Pontiff who waived and the qualifications it retains. The extraordinary nature of the resignation of Benedict the XVI makes it urgent, instead, to consider this profile deeply. In fact the interpreters of canon law, until now, haven’t paid sufficient attention to this aspect. The question introduces, from the perspective de iure condendo, another problem for which it is urgent to find an regulation: a procedure to be activated in the case of a pope, who for illness or other reasons, remains alive for a long time without being capable of discernment. The history of the popes of the twentieth century together with significant advances in medicine have shown that the gap between the Apostolic See vacant and Apostolic See prevented is now very narrow. The last part of the contribution, taking a cue from the criticism of some recent doctrinal theses on resignation of Benedict XVI, explores the whole issue in the context of a balanced ecclesiology, based on correct theological foundations and precise legal coordinates.

Molto è stato scritto sull’evento epocale della rinuncia pontificia cui abbiamo assistito durante il concistoro ordinario pubblico dell’11 febbraio 2013: eppure l’orizzonte è ancora offuscato e confuso. Opportuna quindi una ricostruzione accurata delle coordinate canonistiche della rinuncia del pontefice contemplata nel can. 332 § 2 del Codex Iuris Canonici per la Chiesa latina e nel can. 44 § 2 del Codex Canonum Ecclesiarum Orientalium, oltre che nelle norme racchiuse nella Costituzione Apostolica in vigore sulla vacanza della sede apostolica e sull’elezione del romano pontefice Universi domini gregis del 1996. Il primo capitolo del volume è dedicato alla considerazione della rinuncia all’interno del complesso sistema delle dinamiche potestative nella Chiesa tra potere d’ordine e potere di giurisdizione, mentre il secondo è incentrato su un’analisi approfondita della causa della renuntiatio dal punto di vista giuridico: elemento su cui si è notevolmente equivocato e frainteso, riconducendola esclusivamente all’anzianità e conducendo a proposte inaccettabili nello ius Ecclesiae (come quella di un papato a termine). Dopo essersi soffermati sul perfezionamento, sulla libertà nonché sulla ricettizietà ed efficacia della rinuncia, ci si inoltra poi su un profilo che, attesa la straordinarietà dell’accadimento, non è stato mai oggetto di attenzione da parte della canonististica: quello dello status del pontefice che ha rinunciato, a partire dalla qualifica ad esso spettante. L’argomento induce ad affrontare, in prospettiva de iure condendo, un’ulteriore problematica per la quale è urgente una disciplina normativa: si tratta di congegnare e predisporre una procedura da attivarsi nell’ipotesi di un pontefice che, per malattia o altre ragioni, pur rimanendo in vita, non è più capace di intendere e di volere. La premessa di tale indagine si radica nella storia dei pontificati del XX secolo, nei quali più volte si è posto il quesito della regolazione di un’eventuale sede impedita con la possibilità di un transito verso la sede vacante. L’ultima parte della monografia, infine, prendendo spunto dalla critica di alcune recenti tesi dottrinali sulla rinuncia di Benedetto XVI, riconduce l’intera tematica nel quadro di un’equilibrata ecclesiologia, nutrita di corretti fondamenti teologici e di precise coordinate giuridiche.
