Directive No 2011/77/EU has extended the artists' neighboring rights and enforced a deeper contractual protection for them towards the phongraphic producers. This essay reviews the main goals and the legal tools of this prolongation/enforcement, with strong criticism. On one hand, the contractual protection is too partial and unsatifactory, if not pharisaic; on the other, the tools provided for, as well as the prolongation, will be presumably transferred to (or will play mostly in favor of) the phonogram producers rather than the artists as the “weak party” who needs actual protection.
