Stutz, Ulrich

Ulrich Stutz è stato una delle figure di maggior spicco nel panorama della storia del diritto canonico a cavallo tra il XIX e XX secolo. Secondo il suo insegnamento ed il suo convincimento metodologico, solo una conoscenza profonda della storia porta alla comprensione del diritto positivo e dei suoi istituti. Conoscitore profondo sia dei pilastri della scienza canonistica, sia delle molte microstorie locali che hanno popolato il medioevo del diritto, la sua attenzione si sposta, nella piena maturità, sulle vicende della Riforma protestante ed i rapporti tra le comunità ecclesiali che ne nascono con la Chiesa di Roma, fino ad approdare ad un commento esegetico del codice di diritto canonico del 1917, nel quale intravvede i germi del trionfo della dogmatica giuridica a scapito del metodo storico del quale rimane uno dei maggiori interpreti. Ulrich Stutz was one of the most prominent figures in the panorama of the history of canon law at the turn of the nineteenth and twentieth centuries. According to his teaching and his methodological conviction, only a deep knowledge of the history leads to the understanding of positive law and its institutions. Deep connoisseur of principal pillars of the canonical science, and, at the same time of the many micro-local juridical situations who populated the Middle Ages, shifts his attention, in the maturity, on the events of the Protestant Reformation and on the relationship between the ecclesial communities - which were born in that time - with the Church Rome: to arrive, finally at an exegetical commentary of the Code of canon Law of 1917. In this Code Ulrich Stutz individuates the seeds of triumph of legal dogmatics at the expense of the historical method, whose he remains one of the greatest performers.
