Objective 14: Enhance Consular Protection, Assistance and Cooperation Throughout the Migration Cycle

This chapter examines Objective 14 of the GCM, which addresses the critical and evolving role of consular protection in safeguarding migrants’ rights. The Objective’s major contribution is its innovative promotion of institutionalized links between the traditionally separate consular and migration sectors. The Vienna Convention on Consular Relations, that is the foundational document of international consular law, has been insufficient in the face of contemporary challenges. Objective 14 captures this shift in international law by affirming a dual state commitment to strengthen assistance for nationals abroad and to enhance interstate consular cooperation, particularly for states lacking overseas presence. This framework transforms consular protection from a discretionary state right into an effective duty of care, making it a vital complement to human rights law. The chapter concludes that, by formalizing cooperation as a necessity in a mobile world, Objective 14 ensures consular systems are a proactive tool for migrant protection, preventing anyone from being left unprotected.
