“Ecclesial Cultural Heritage”, or Patrimonial, Cultural, Ecclesial Dimensions: in Search of a Balance. Legal scholarship has almost unanimously criticized the limited attention paid to the cultural significance of ecclesial goods, both in 1917 Codex Iuris Canonici and in the codification that emerged from post-conciliar reflection. Indeed, both Codes focus on primarily on the religious, liturgical and devotional character of this heritage, while, from a different perspective, they address the safeguards required for their administration as temporal goods. This essay, by contrast, highlights the prudence and far-sightedness of the codified legislator, who sought to protect and promote the ecclesial nature of these goods – their very matrix and soul – without which their cultural value would likewise be lost.
La dottrina ha pressoché unanimemente stigmatizzato la scarsa attenzione che non solo il Codex Iuris Canonici del 1917, ma anche la codificazione frutto della riflessione post-conciliare dedica alla valenza culturale dei beni ecclesiali: incentrandosi principalmente sulla loro importanza culturale, liturgica, devozionale, nonché, su altro versante, soffermandosi sulle cautele da predisporsi in relazione alla loro gestione quali beni temporali. Nel saggio invece si pone in luce l’accorta prudenza e la lungimiranza del legislatore codiciale, che si è preoccupato di salvaguardare e promuovere quell’ecclesialità del bene che ne è la matrice e l’anima: e senza la quale si dissolve anche ogni valore culturale.
