Following the structure adopted in the volume 'Matrimonio e famiglia tra diritti religiosi e diritti secolari', this handbook is likewise divided into two parts: 'Generalia' and 'Quaestiones', that is, general principles and the specific issues referred to in the title. This bipartite structure, however, marks neither a separation nor, still less, an opposition. Rather, the matters developed in the first three chapters and the issues examined in the subsequent ones are connected by an exceptionally dense and inseparable network of relationships and interdependencies. Indeed, only by considering the topics addressed as a whole can an overall picture of the subject emerge. Such a picture is, inevitably, 'imperfect': neither complete nor exhaustive, and sketched through brushstrokes that are necessarily light and nuanced, often raising problems and questions rather than setting forth definitive, ready-made solutions. Completeness and exhaustiveness are, of course, unattainable goals in a handbook, nor have we ever entertained such ambitions. Our more modest, yet still demanding, hope is that the 'windows' of understanding opened onto the law relating to the religious phenomenon, notwithstanding all their limitations and shortcomings, may inspire readers with a passion for the subject, encouraging them to broaden their horizons and pursue a deeper study of this field. Our shared purpose has therefore been, once the fundamental principles have been clarified and certain interpretative tools provided – often rooted in history, yet indispensable for understanding contemporary legal reality – to focus primarily on those topics which, as experience over the years has shown, most strongly attract students' interest and curiosity. The handbook is clearly addressed to them; it was conceived and written for them, not merely with the limited objective of passing an examination, but with the broader perspective of each student's future professional vocation and career in mind. For this reason, we considered it essential – through a choice that is unusual and original within the landscape of academic handbooks, but which appeared to us not merely appropriate but indispensable – to give a voice to those who, in several important professional fields in which lawyers exercise their functions, are called upon every day to engage with ecclesiastical law in its various forms and from its different perspectives. To these professionals, to their expertise and authority, and also to the passion that so visibly inspires them, we extend our most sincere gratitude for the invaluable contribution they have made. For nothing is more detrimental to a scholar and practitioner of law than the dissociation of theory from practice, or the divorce of scholarship from the realities of life.
Riprendendo la sistematica adottata nel volume 'Matrimonio e famiglia tra diritti religiosi e diritti secolari', la trattazione si articola anche nel presente manuale in due parti: 'Generalia' e 'Quaestiones', cioè i principi generali e le questioni di cui al titolo. Una bipartizione, invero, che non segna una separazione, né, tantomeno, una contrapposizione, essendoci, tra quanto sviluppato nei primi tre capitoli e i profili messi a fuoco in quelli successivi, una rete fittissima e indissolubile di connessioni e legami: d'altronde, è unicamente dalla considerazione complessiva delle tematiche illustrate che può emergere un quadro d'insieme della materia. Un quadro, evidentemente, 'imperfetto', non completo né esaustivo, tracciato con pennellate che fatalmente risultano leggere e sfumate: le quali spesso, poi, sollevano problemi e interrogativi piuttosto che enunciare soluzioni tassative e preconfezionate. La completezza e l'esaustività non sono, ovviamente, obiettivi raggiungibili in un manuale, né abbiamo mai coltivato simili pretese: l'auspicio, più modesto eppure impegnativo, è quello che le 'finestre' di comprensione aperte sul diritto afferente al fenomeno religioso, pur con tutti i limiti e le manchevolezze, possano suscitare la passione in chi legge, portandolo ad allargare l'orizzonte e ad approfondire ulteriormente lo studio di quest'ambito disciplinare. L'intento perseguito insieme è stato quello, una volta delucidati i principi fondamentali di base e fornite alcune chiavi di lettura, non di rado radicate nella storia eppure indispensabili per decifrare la realtà giuridica contemporanea, di soffermarci in via prevalente su quegli argomenti che – si è riscontrato negli anni – attraggono maggiormente l'interesse e la curiosità degli studenti. A loro è chiaramente rivolto il manuale, per loro è stato pensato e realizzato: non solo nella limitata prospettiva del superamento di un esame, ma nella prospettiva più dilatata della futura vocazione e occupazione di ciascuno. Per questo abbiamo reputato essenziale – con una scelta atipica e originale nel panorama della manualistica, ma che ci è parsa non tanto opportuna quanto imprescindibile – dare voce a chi, in alcuni importanti ambiti lavorativi in cui il giurista dispiega le sue funzioni, è chiamato quotidianamente a confrontarsi con il diritto ecclesiastico, nei suoi differenti volti e angolature.
