The contribution illustrates the cornerstones of the religious freedom of groups: on the one hand, by describing the contents of article 20 of the Italian Constitution; on the other, by focusing on the regulation of civilly recognized ecclesiastical (or religious) entities. In this latter regard, it presents the implications of recognition as a civil-law legal person: its general and specific requirements, the various recognition procedures, registration in the register of legal persons, the civil relevance of canonical controls, the performance of activities other than religious and worship ones, respect for the entity’s structure and purpose, the carrying out of commercial activities and the implications of any substantial changes.
Il contributo illustra i capisaldi della libertà religiosa dei gruppi: da un lato descrivendo i contenuti dell'art. 20 Cost., dall'altro soffermandosi sulla disciplina degli enti ecclesiastici (o religiosi) civilmente riconosciuti. A quest'ultimo proposito, vengono presentati i risvolti del riconoscimento della personalità giuridica civile: i suoi requisiti generali e specifici, le varie procedure di riconoscimento, l'iscrizione nel registro delle persone giuridiche, la rilevanza civile dei controlli canonici, lo svolgimento di attività diverse da quelle di religione e di culto, il rispetto della struttura e della finalità dell'ente, lo svolgimento di attività commerciali, le implicazioni degli eventuali mutamenti sostanziali.
