The author argues that family arbitration can provide a more flexible, specialized, and tailored approach compared to ordinary court proceedings, ensuring greater procedural efficiency and higher-quality decisions. The paper examines the main objections concerning the admissibility of family arbitration, particularly regarding public interests and the protection of children. It concludes that, although arbitration is not suitable for every family dispute, it may represent an effective and innovative tool whenever party autonomy can coexist with the need to safeguard the interests at stake.
L’articolo analizza il possibile ruolo dell’arbitrato nella gestione della crisi familiare, evidenziandone vantaggi e limiti. L’autrice sostiene che l’arbitrato possa offrire una soluzione più flessibile, specialistica e personalizzata rispetto al processo ordinario, garantendo tempi più efficienti e una maggiore qualità decisionale. Vengono esaminate le principali obiezioni relative all’ammissibilità dell’arbitrato familiare, soprattutto in relazione agli interessi pubblici e alla tutela dei minori. La conclusione è che l’arbitrato, pur non essendo adatto a ogni controversia familiare, rappresenta uno strumento utile e innovativo nei casi in cui l’autonomia delle parti possa conciliarsi con le esigenze di protezione degli interessi coinvolti.
