This volume is an interdisciplinary and multidisciplinary collection of works that analyses the phenomenon of CERs from all angles, integrating aspects of public and private law with those related to economics and engineering. The volume is therefore aimed at students, researchers and teachers in disciplines related to energy law, engineering and economics. In terms of content, the work critically addresses the application of European regulations as transposed by the Italian legislator, highlighting the gap between regulatory potential and the actual spread of energy communities in Italy. It also examines crucial issues for energy communities, including contractual autonomy, local government, the role of local authorities, sustainable legal models, economic analysis and plant configurations. The innovative interdisciplinary approach starts with a comparative analysis of some European experiences (such as Germany and Greece), before delving into the issues of horizontal subsidiarity and social aggregation, alongside significant reflections on the energy transition in relation to urban planning. It is therefore a useful work for understanding the challenges and prospects of CERs in the transition towards the more complete diffusion of renewable energies in Italy.
Il presente volume rappresenta un’opera collettanea dal taglio interdisciplinare e multidisciplinare, che analizza il fenomeno delle CER "a 360 gradi", integrando profili di diritto pubblico e privato, e aspetti legati alle scienze economiche ed ingegneristiche. Il volume, pertanto, si rivolge sia agli studenti, sia ai ricercatori e docenti delle discipline legate al diritto dell’energia, all’ingegneria e all’economia. Sul piano dei contenuti, l’opera affronta criticamente l'applicazione delle normative europee come recepite dal legislatore italiano, evidenziando il divario tra potenzialità normative e diffusione effettiva delle comunità energetiche in Italia. Esamina inoltre, nodi cruciali delle comunità energetiche tra autonomia contrattuale, governo del territorio, ruolo degli enti locali, modelli giuridici sostenibili, analisi economica e configurazioni impiantistiche. L’approccio interdisciplinare innovativo parte dalla presenza di un’analisi comparata con alcune esperienze europee (come la Germania e la Grecia), per poi approfondire le tematiche della sussidiarietà orizzontale e dell’aggregazione sociale, accanto a significative riflessioni sulla transizione energetica in rapporto con la pianificazione urbanistica. È dunque un’opera utile per comprendere le sfide e le prospettive delle CER nella transizione verso la più completa diffusione delle energie rinnovabili in Italia.
