La volontà macchinica. Realità e soggettività

The choice of the title brings together will and machine: will, which has always been the driving force of law, now seems to shift its point of reference from the human being to the machine. The implications are immense, on every level: philosophical, ethical, anthropological, even theological and, of course, legal. In the face of a disruptive technology destined to bring about profound, pervasive, and rapid change, it is appropriate to examine carefully the system of civil law rules — inspired by the unspoken assumption that every form of liability is attributable to human action (and intelligence) — and to question their continuing adequacy.

La scelta del titolo unisce volontà e macchina: la volontà, da sempre motore del diritto, sembra ora spostare il proprio centro di imputazione dall’essere umano alla macchina. Le implicazioni sono immense, su ogni piano: filosofico, etico, antropologico, persino teologico e, naturalmente, giuridico. Al cospetto di una tecnologia dirompente, destinata a produrre mutamenti profondi, pervasivi e rapidi, è opportuno esaminare con attenzione il sistema delle regole del diritto civile — ispirate al presupposto inespresso che ogni forma di responsabilità sia riferibile all’azione (e all’intelligenza) umana — e interrogarsi sulla loro perdurante adeguatezza.
