This essay aims to investigate, from a legal science perspective, the phenomenon of equalization which, as an institution of urban law, initially a “technical” and then a legal instrument, has now become a fundamental principle of land management law in the era of ecological transition. Starting from the origins of this phenomenon, we attempt to reconstruct—using the fundamental conceptual “volumes” provided by urban planning literature and administrative and private law (between doctrine and jurisprudence) – the fundamental structure of equalization and its experiences, in order to imagine a new system, more in line with the current era, where ‘equalizing’ means not only managing volumes on a larger scale than the restricted municipal level, but also to govern the territory with a view to protecting and enhancing environmental resources (such as soil) without dispersing the value of real estate, taking into account the fundamental implications at the infrastructural level and without neglecting the needs related to the vertical increase in housing demand. The aim is to understand how to bring together the governance of the territory (a subject that still lacks fundamental principles) and the environment—subjects that are converging but still far from full functional integration—in order to allow for better performance of the related administrative functions. Finally, in order to ensure a systematic and comprehensive overview of the issue, an attempt is made to answer the vexed question of the legal nature of building rights, as generated by various forms of equalization, including the recent technique of “unsealing,” a point of contact between land management, the environment, and civil law.

Il presente lavoro si pone l’obiettivo di indagare, sul piano della scienza giuridica, il fenomeno della perequazione il quale, da istituto del diritto urbanistico, dapprima strumento “tecnico” e poi giuridico, è divenuto oramai un fondamentale principio del diritto del governo del territorio nell’epoca della transizione ecologica. Partendo dalle origini del predetto fenomeno, si tenta di ricostruire – con i fondamentali “volumi” concettuali messi a disposizione dalla letteratura ur- banistica e del diritto amministrativo e privato (tra dottrina e giurisprudenza) –la struttura por- tante della perequazione e delle sue esperienze, per arrivare a immaginare un nuovo sistema, maggiormente attualizzato all’epoca corrente, dove “perequare” significa non soltanto gestire i volumi in una scala più ampia del ristretto livello comunale, ma altresì governare il territorio con l’ottica di tutelare e valorizzare le matrici ambientali (come il suolo) senza disperdere i va- lori della proprietà immobiliare, assumendo come fondamentali le implicazioni sul piano infra- strutturale, e senza trascurare le esigenze legate al verticale aumento della domanda abitativa. Il tentativo è quello di capire come tenere insieme il governo del territorio (materia non dotata tutt’oggi di principi fondamentali della materia), e l’ambiente – materie in avvicinamento ma ancora lontane da una piena integrazione funzionale – al fine di consentire un migliore esple- tamento delle correlate funzioni amministrative. Infine, per garantire un quadro sistematico e completo del tema, si tenta di rispondere alla ve- xata quaestio circa la natura giuridica dei diritti edificatori, come generati dalle diverse forme di perequazione, compresa la recente tecnica di “desigillazione”, punto di contatto tra governo del territorio, ambiente e ordinamento civile.
