The essay first analyzes international law and the jurisprudence of the ECHR with the aim to verify whether binding indications can be found to harmonize States' disciplines about protection of the relationship between the intended parent and the minor born through surrogacy. Building on the criteria identified by the ECHR for a family life to be protected, the most important of which is the duration of cohabitation, the author questions the possibility of developing this principle in order to identify a period of cohabitation, after which the relationship between the intended parent and the minor must necessarily be recognized.
