Dagli ordini ai sindacati: l'avvocatura in età fascista

The aim of this essay is to trace the events that led, during the Fascist era, to the coexistence of the Bar Associations and the Syndicates, until the suppression of the former and the concentration in the latter of the power of representation of the category, the maintenance of professional registers and the disciplinary power over its members (Royal Decree Law no. 1578 of November 27, 1933), thus exercising exclusive control over the class, in a totalitarian design that no longer conceded anything to forensic autonomy.

Il saggio intende ripercorrere le vicende che hanno portato in età fascista prima alla convivenza tra ordini forensi e sindacati, poi alla soppressione dei primi e alla concentrazione nei secondi della rappresentanza della categoria, della tenuta degli albi professionali e del potere disciplinare sugli iscritti (regio decreto legge 27 novembre 1933, n. 1578), esercitando così un controllo esclusivo sul ceto, in un disegno totalitario che non concedeva più nulla all’autonomia forense.
