The rise of e-commerce has made digital platforms key players in the exchange of goods and services. However, this expansion has also facilitated the commission of industrial and intellectual property infringements through them. This paper aims to analyse whether e-commerce platforms can be held directly liable for trademark infringements committed by third-party sellers. It will examine the conditions under which this liability can be attributed to them, considering the current legal framework and the evolution of the case law of the Court of Justice of the European Union.
