In March 2019, the Spanish Competition Authority (CNMC) imposed the first-ever bidder exclusion for competition infringement. Since then, extensive discussions have taken place regarding its legal nature, application procedure, effects, and related matters. However, two judgments from the High Court of Justice in the Spanish region of Catalonia have subsequently caused the Spanish Competition Authority to reconsider its criteria. This paper examines the traditional approach of the national authority in implementing debarment decisions and the corresponding communication on this subject.
